These terms apply to the Uwear mobile app β a virtual try-on app for shoppers available on iOS and Android.

1. Acceptance of Terms
By accessing or using the Uwear mobile application ("App"), you agree to be bound by these Terms of Service. If you do not agree to these Terms, do not download or use the App.
2. Eligibility
You must be at least 13 years old to use the App. By using the App, you represent and warrant that you meet this age requirement.
Age verification is performed during the app onboarding process. The App is designed for users aged 13 and above only, and children under 13 are not permitted to access or use the App.
3. Account Registration
To use the App, you must create an account by providing:
- β’ A valid email address
- β’ A username
- β’ An upper body photograph with your face (for personalized try-on experiences)
You are responsible for maintaining the security of your account and all activities under your account.
4. User Content and Conduct
You agree not to upload or create content that is:
- β’ Harmful, offensive, or inappropriate
- β’ Misleading or fraudulent
- β’ Violates intellectual property rights
- β’ Contains malware or harmful code
- β’ Violates App Store or Play Store guidelines
You must only upload photos you own or have permission to use.
5. Child Safety and Protection
Zero Tolerance Policy
Uwear has a strict zero-tolerance policy for Child Sexual Abuse and Exploitation (CSAE) content and Child Sexual Abuse Material (CSAM).
Prohibited Content and Conduct
The following are strictly prohibited on the Uwear App and will result in immediate account termination and reporting to appropriate authorities:
- β’ Any content depicting, promoting, or facilitating child sexual abuse or exploitation (CSAE)
- β’ Child Sexual Abuse Material (CSAM) in any form, including photographs, videos, text, or AI-generated imagery
- β’ Content that sexualizes, endangers, or exploits minors
- β’ Content that depicts, encourages, or promotes the sexual abuse or exploitation of children
- β’ Any grooming behavior or attempts to contact minors for inappropriate purposes
- β’ Content that depicts minors in a sexual or suggestive manner
- β’ Any attempt to use our AI technology to generate inappropriate content involving minors
Enforcement and Detection
We employ multiple measures to protect children and prevent CSAE/CSAM on our platform:
- β’ Automated Detection: We use industry-standard detection technologies to identify and remove CSAM
- β’ Human Review: Our moderation team reviews flagged content and user reports
- β’ Age Verification: Users must be at least 13 years old to use the App. Age verification is performed during onboarding to ensure children cannot access the platform
- β’ Content Filtering: Our AI systems are designed to reject requests that may generate inappropriate content
- β’ Immediate Removal: Upon detection or report, CSAE/CSAM content is immediately removed from our platform
Reporting Mechanism
If you encounter content that violates our child safety policies, you can report it through any of the following methods:
- In-App Reporting: Use the in-app feedback button to report policy violations, including child safety concerns

- Emergency Contact: For urgent matters involving immediate danger to a child, contact local law enforcement immediately
All reports are reviewed promptly by our team. We investigate all reports within 24 hours and take appropriate action, which may include content removal, account suspension or termination, and reporting to law enforcement authorities.
Cooperation with Authorities
Uwear cooperates fully with law enforcement agencies and child protection organizations:
- β’ We report CSAM to the National Center for Missing & Exploited Children (NCMEC) as required by law
- β’ We comply with all applicable laws regarding mandatory reporting of child abuse and exploitation
- β’ We preserve evidence and cooperate with law enforcement investigations
- β’ We maintain a designated point of contact for child safety concerns from platform operators and authorities
User Responsibility
By using the Uwear App, you acknowledge and agree that:
- β’ You will not upload, create, share, or attempt to generate content involving minors in any inappropriate manner
- β’ You will immediately report any CSAE/CSAM content you encounter on the platform
- β’ You understand that violations of this policy will result in immediate account termination
- β’ You may be reported to law enforcement authorities for violations of child safety laws
- β’ You will not use the App's AI technology to create any content that could endanger or exploit children

6. AI-Generated Content
Important: AI-generated content may not be 100% accurate. While we strive for quality, AI technology can produce unexpected results.
You own the AI-generated images created through the App and may share them freely. However, we are not responsible for how you use or share these images.
7. Credits and Payments
Credit System
- β’ Free users receive 12 credits every Thursday at 1:00 AM EST
- β’ Credits are used for AI clothing try-ons
- β’ Additional credits can be purchased through in-app purchases

β’ Includes: 100 credits plus premium features
β’ Auto-renews weekly unless canceled
Refund Policy
All purchases are final and non-refundable unless required by law. For platform-specific refund processes:
- β’ iOS: Refunds must be requested through Apple Support
- β’ Android: Refunds must be requested through Google Play Support
8. Intellectual Property Rights
The App and its content (excluding user-generated content) are protected by copyright, trademark, and other intellectual property laws.
Your Content: You retain ownership of photos you upload. By using the App, you grant us a license to process your images to provide the Service.
9. Privacy
Your use of the App is governed by our Privacy Policy.

- β’ We do not share personal data without consent
- β’ We comply with App Tracking Transparency (iOS) and similar requirements
- β’ Data is stored on AWS S3 servers with encryption
10. Restrictions
You may not:
- β’ Reverse engineer, decompile, or disassemble the App
- β’ Use the App for any illegal purpose
- β’ Attempt to gain unauthorized access to our systems
- β’ Use automated tools to access the App
- β’ Resell or redistribute the App or its content
11. Account Termination
We reserve the right to suspend or terminate your account for violations of these Terms.
Account Deletion: When you delete your account, we maintain a 30-day archive period before permanent deletion. During this period, you can recover your account by contacting support.
12. Disclaimers
THE APP IS PROVIDED "AS IS" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED. WE DO NOT WARRANT THAT THE APP WILL BE UNINTERRUPTED, ERROR-FREE, OR COMPLETELY SECURE.
13. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, UWEAR.AI SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING FROM YOUR USE OF THE APP.
14. Indemnification
You agree to indemnify and hold harmless Logiciel Uwear.ai Inc. from any claims, damages, or expenses arising from your use of the App or violation of these Terms.
15. DMCA Copyright Policy
We respect intellectual property rights. If you believe your copyright has been infringed, please see our DMCA Copyright Policy for information on how to file a notice.
16. Dispute Resolution
Arbitration
Any disputes arising from these Terms shall be resolved through binding arbitration conducted by the ADR Institute of Canada in Montreal, Quebec.
Governing Law
These Terms are governed by the laws of Quebec, Canada, without regard to conflict of law provisions.
17. Changes to This Agreement
We reserve the right to modify these Terms at any time. Material changes will be communicated through the App or via email. Continued use after changes constitutes acceptance.
