DMCA Copyright Policy

Overview

Logiciel Uwear.ai Inc. ("Uwear.ai") respects the intellectual property rights of others and expects our users to do the same. We comply with the Digital Millennium Copyright Act (DMCA) and will respond to valid notices of copyright infringement.

1. Respect for Copyright

As a user of Uwear.ai, you agree:

  • • To only upload images you own or have permission to use
  • • Not to infringe on the copyrights, trademarks, or other intellectual property rights of others
  • • To respect all applicable copyright laws
  • • That we may remove content that infringes on third-party rights

2. Filing a DMCA Copyright Infringement Notice

If you believe that content on Uwear.ai infringes your copyright, you may submit a DMCA takedown notice to our Designated Copyright Agent (see contact information below).

Please note: Filing a false or bad faith DMCA notice may result in legal liability. If you are unsure whether content infringes your copyright, consult an attorney before proceeding.

3. DMCA Notice Requirements

To be effective, your DMCA notice must include the following information:

1. Identification of the copyrighted work

Describe the copyrighted work you claim has been infringed. If multiple works are covered by a single notification, provide a representative list.

2. Identification of the infringing material

Provide sufficient information to locate the allegedly infringing content on our service (e.g., URL, username, description of the content).

3. Your contact information

Include your name, address, telephone number, and email address.

4. Statement of good faith belief

Include a statement that you have a good faith belief that the use of the material is not authorized by the copyright owner, its agent, or the law.

5. Statement of accuracy

Include a statement, under penalty of perjury, that the information in your notice is accurate and that you are the copyright owner or authorized to act on behalf of the copyright owner.

6. Physical or electronic signature

Provide a physical or electronic signature of the copyright owner or person authorized to act on their behalf.

4. Counter-Notification Procedure

If you believe that content you posted was removed in error or as a result of misidentification, you may file a DMCA counter-notification.

Counter-Notice Requirements

Your counter-notification must include:

  • • Your name, address, telephone number, and email address
  • • Identification of the removed content and its location before removal
  • • A statement under penalty of perjury that you have a good faith belief the content was removed by mistake or misidentification
  • • A statement consenting to the jurisdiction of the federal court in your location (or Montreal, Quebec if outside Canada)
  • • A statement that you will accept service of process from the person who filed the original DMCA notice
  • • Your physical or electronic signature

Processing Time: Upon receipt of a valid counter-notification, we will forward it to the original complainant. If the complainant does not file a court action within 10-14 business days, we may restore the removed content.

5. Repeat Infringers Policy

Uwear.ai has a policy of terminating, in appropriate circumstances, the accounts of users who are repeat copyright infringers.

We reserve the right to suspend or terminate accounts that receive multiple valid DMCA notices or otherwise demonstrate a pattern of copyright infringement.

6. False Claims and Misrepresentation

Warning: Under Section 512(f) of the DMCA, anyone who knowingly misrepresents that content is infringing or was removed by mistake may be liable for damages, including costs and attorney's fees.

Please ensure that your DMCA notice or counter-notification is accurate and made in good faith. False claims can result in serious legal consequences.
